1) Agreement & Scope

 

These Terms of Service (“Terms”) govern your use of the website and online scheduling operated by Two Aces Tactical AZ at www.TwoAcesTacticalAZ.com (the “Site”), and your participation in our classes, courses, clinics, and events (“Training”). By using the Site or registering for Training, you agree to these Terms and to our Privacy Policy.

Submitting a form or inquiry does not create a services engagement. Training is confirmed only when you complete registration, accept these Terms (including the Assumption of Risk & Release below), and receive our written confirmation.

Safety note: Training is not an emergency service.

3) Eligibility & Legal Compliance

You must be 18+ to register (minors only if a course explicitly permits and a parent/guardian sign all required documents on-site). You represent that you are not a prohibited possessor under Arizona or federal law and may lawfully handle firearms/ammunition. You agree to comply with all applicable Arizona and federal firearms laws and with posted range rules.

4) Safety Rules (Condition of Participation)

​

You agree to:

• Arrive sober, no alcohol or impairing drugs before or during Training.

• Use required PPE (eye/ear protection, etc.);

• Follow range commands immediately; maintain safe muzzle and trigger discipline at all times.

• Bring only range-approved ammunition or as specified in course details.

• Use firearms/gear that are in safe working order;

• Report unsafe behavior or equipment immediately.

We may remove any participant for unsafe conduct or policy violations without refund.

5) Third-Party Facilities & Contractors

​

We may utilize independent ranges, instructors, medical/EMT, role-players, and specialty vendors. These parties are independent contractors, not employees or agents of Two Aces Tactical AZ. They are responsible for their own licenses, insurance, and compliance. You may be required to sign venue-specific waivers to enter and participate.

6) Assumption of Risk; Release; Waiver; Indemnity (Arizona)

​

Inherent Risks. Live-fire firearms training is a dangerous activity that can cause serious injury or death, including gunshot wounds, burns, lacerations, hearing/vision injury, lead exposure, slips/falls, environmental hazards, equipment malfunctions, and injuries caused by other participants.

Assumption of Risk. You voluntarily assume all inherent risks associated with Training, including risks from the acts or omissions of other participants and third-party facilities.

Release & Waiver (to the fullest extent permitted by Arizona law). You release and discharge Two Aces Tactical AZ and its owners, managers, employees, contractors, instructors, vendors, and range partners from any and all claims, liabilities, demands, losses, damages, or causes of action arising out of or related to your participation in Training, including claims resulting from the ordinary negligence of any released party. This waiver does not release claims that cannot legally be waived (including gross negligence or willful/wanton misconduct).

Indemnity. You agree to defend, indemnify, and hold harmless Two Aces Tactical AZ from any third-party claims, damages, or expenses (including reasonable attorneys’ fees) arising from your participation, your violation of law or rules, your equipment, or your acts/omissions.

Medical Fitness. You certify that you are medically fit for Training and may stop participation at any time for safety.

7) Prohibited Conduct

​

You agree not to: bring unlawful weapons or unauthorized explosive materials; handle firearms while impaired; violate range commands or safety rules; record restricted segments; distribute proprietary course materials without permission; or engage in conduct that endangers others. We may remove violators and bar future participation.

8) Scheduling; Cancellations; Refunds

​

• Your cancellation: Unless a course description states otherwise, you may cancel up to 7 days before class for a credit toward a future class; no refunds inside 7 days.

• Our cancellation: We may reschedule or cancel for safety, weather, range closures, instructor illness, or low enrollment. If we cancel without an alternative date, we will issue a credit or refund (our choice).

• No refund/credit if you are removed for safety violations or arrive impaired/unprepared

9) Equipment; Damage

​

You are responsible for your firearms, gear, ammunition, and personal property. We are not responsible for lost, stolen, or damaged items. You agree to pay for damage you cause to range property beyond ordinary wear.

10) Intellectual Property; Recordings

​

Our curriculum, drills, videos, and materials are proprietary. No recording, reproduction, or distribution without written permission. We may capture training photos/video; if you object, tell us before class so we can accommodate.

11) No Warranties

​

THE SITE, TRAINING, AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NO SPECIFIC OUTCOME OR SKILL LEVEL IS GUARANTEED.

12) Limitation of Liability

​

TO THE MAXIMUM EXTENT ALLOWED BY ARIZONA LAW, TWO ACES TACTICAL AZ AND THE RELEASED PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, OR BUSINESS INTERRUPTION.
CAP: OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE OR A SPECIFIC CLASS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT CLASS.

13) Medical Care; Emergency Consent

​

If injury occurs, you authorize basic first aid and emergency response, and authorize release of relevant information to responders. You are responsible for all medical costs.

14) Dispute Resolution; Governing Law; Venue (Arizona)

​

These Terms are governed by Arizona law. Except for claims seeking temporary or emergency injunctive relief, all disputes shall be resolved by binding arbitration in Phoenix, Arizona, on an individual basis (no class or representative actions), administered by a recognized arbitration provider. For any non-arbitrable claims, venue and jurisdiction lie exclusively in the state or federal courts in Maricopa County, Arizona.

15) Force Majeure

​

We are not liable for delays or failures due to events beyond reasonable control, including emergencies, outages, severe weather, labor issues, civil disturbances, or governmental actions.

​

16) Assignment; Severability; Entire Agreement; No Waiver

​

You may not assign these Terms without our written consent. If any provision is unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and any course-specific waivers, are the entire agreement regarding the Site and Training. No waiver is effective unless in writing and signed.

17) Changes

​

We may update these Terms by posting a revised version with a new Effective Date. Continued use or participation after changes means you accept them.
